Summary THIS IS A TITLE 32 DUAL STATUS POSITION DUTY LOCATION: Office of the Staff Judge Advocate (OSJA), Hartford, CT AREA(S) OF CONSIDERATION: Area 1: All currently employed full-time permanent and indefinite personnel of the CTARNG. Area 2: All currently employed full-time temporary technician personnel and all current traditional members of the CTARNG. Area 3: Individuals eligible for membership in the CTARNG. Membership must be satisfied within four (4) months of selection. Responsibilities A Biweekly Retention Incentive of up to 25% may be paid to the selected applicant of this position (pending funds availability), providing that the selectee is eligible. Employees currently serving a trial period are not eligible for a Retention Incentive, and the employee must have a rating of record of at least fully successful to be eligible. A signed three-year service agreement is required before the Retention Incentive can begin to be paid. A Recruitment Incentive of up to 25% may be paid to the selected applicant of this position (pending funds availability), who is newly appointed to the federal government in this position (or if appointment to this position follows a temporary appointment, or a break in federal service of at least 90 days); acceptance of this incentive confers a three-year service agreement in this position. A Relocation Incentive of up to 25% may be paid to the selected applicant of this position (pending funds availability) if he or she is a current federal employee of the US Federal Government. Acceptance of this incentive confers a three-year service agreement in this position. JOB SUMMARY: The purpose of the position is to provide full-time professional legal support to the State Adjutant General, staff elements and subordinate units of the Army and Air National Guard of the State, as well as to the USPFO for the State. NATIONAL GUARD MEMBERSHIP IS REQUIRED. This is an excepted position that requires membership in a compatible military assignment in the Connecticut Army National Guard. Applicants who are not currently a member of the Connecticut Army National Guard must be eligible for immediate membership and employment in the Connecticut Army National Guard. The major duties include, but are not limited to: Responsible for the effective management and accomplishment of the day-to-day legal workload necessary to provide legal services and support to the Adjutant General, staff elements of both the Army and Air National Guard and subordinate units, as well as the United States Property and Fiscal Officer for the State and his staff. Provides professional legal advice and opinions, both written and oral, on issues arising from federal laws and regulations or concerning the federal mission of the National Guard. Serves as litigation point of contact for the State. Acts as the State Adjutant General's representative in third-party proceedings under the Federal Labor-Management Relations Statute. Serves as claims officer for the State. Provides legal assistance services to eligible service members, retirees and their dependents. Requirements Conditions of Employment Qualifications GENERAL EXPERIENCE: Must possess a professional law degree (LL.B. or J.D.), from a law school accredited by the American Bar Association -AND- an active Bar membership in good standing of a state, territory of the United States, District of Columbia, or Commonwealth of Puerto Rico Bar. SPECIALIZED EXPERIENCE: Your resume and any other supporting documentation you wish to provide must clearly substantiate you currently possess 36 months of specialized experience in the following: Experience, education or training in the preparation of cases for trial and/or tries cases before a court or an administrative body of persons having quasi-judicial power, the rendering of legal advice and services with respect to questions, regulations, practices or other matters falling within the purview of a Federal Government, the preparation of interpretive and administrative orders, rules, or regulations to give effect to provisions of governing statutes or other law requirements. Experience analyzing, discussing and providing oral and written counsel on complex legal arguments in a representative capacity in a manner that aids the recipient in understanding the issues, options, and recommended courses of action. KNOWLEDGE, SKILLS AND ABILITIES: Knowledge of and ability to analyze and evaluate complex legal problems. Knowledge of a wide range to Federal and State contracting statuses; Domestic Operations Law; and general law, including but not limited to matters involving contract bid, award, environmental, Freedom of Information AVT (FOIA) and Privacy Act; Executive Orders and Agency Directives. Ability to provide advice on operational law and mobilization matters to include pre-deployment and post-deployment. Knowledge of wills, power of attorneys, living wills, and similar personal documents. Ability to apply high levels of sound, independent judgment in the solution of legal problems. Ability to make oral and written legal presentations in a clear and concise manner. CONDITION OF EMPLOYMENT: Training at the National Guard Professional Education Center (NGPEC) is a mandatory condition of employment, subject to availability of resources. NGB prescribed courses at NGPEC must be completed within 6 months of assignment to this position. Failure to complete course(s) may result in reassignment or termination of full-time employment unless extenuating circumstances preclude course attendance. COMPATIBLE MILITARY ASSIGNMENT: All applications will be considered regardless of Branch/AOC/FA/MOS. Incumbent will be required to be assigned to compatible military position within 1 year of selection. The selected individual may be required to attend formal technician school training. MILITARY GRADE (Prior to Appointment): Officer: O-2 through O-3 UNIT OF ASSIGNMENT: Any unit within state Education No substitution of education for specialized experience. FOREIGN EDUCATION: Education completed in foreign colleges or universities may be used to meet the requirements. You must show proof the education credentials have been deemed to be at least equivalent to that gained in conventional U.S. education program. It is your responsibility to provide such evidence when applying. You must provide transcripts or other documentation to support your educational claims. To receive credit for education, you must provide documentation of proof that you meet the education requirements for this position. Additional Information Primary Change of Station (PCS) relocation expenses will NOT be paid. To ensure compliance with an applicable preliminary nationwide injunction, which may be supplemented, modified, or vacated, depending on the course of ongoing litigation, the Federal Government will take no action to implement or enforce the COVID-19 vaccination requirement pursuant to Executive Order 14043 on Requiring Coronavirus Disease 2019 Vaccination for Federal Employees. Therefore, to the extent a Federal job announcement includes the requirement that applicants must be fully vaccinated against COVID-19 pursuant to E.O. 14043, that requirement does not currently apply. Federal agencies may request information regarding the vaccination status of selected applicants for the purposes of implementing other workplace safety protocols, such as protocols related to masking, physical distancing, testing, travel, and quarantine. In order to avoid losing your incentive eligibility, you should check with your serving incentive manager (CTARNG-G1 or CTANG-Retention Office) prior to accepting an offer for the position. For M-Day/Traditional personnel who are currently receiving incentives to include Bonuses and the Student Loan Repayment Program, the following termination rule applies: Incentive Termination without Recoupment: If you accept a Military Technician (Mil Tech) Permanent position where membership in the National Guard is a condition of employment, your bonus will be terminated with no recoupment as long as you have served at least 6 months of the bonus contract following receipt of the initial bonus payment.
